Our service agreement and the terms governing our professional relationship

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and DazzleDeer Courses PTY LTD ABN 12 345 678 901 ("DazzleDeer," "we," "us," or "our").

By engaging our services, accessing our website, or entering into a service agreement with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Our Services

Immigration Services

DazzleDeer provides professional immigration services including but not limited to:

  • Visa application preparation and lodgement
  • Immigration advice and consultation
  • Skills assessment guidance
  • Document preparation and review
  • Government liaison and representation
  • Migration planning and strategy development

Professional Standards

All immigration advice is provided by Migration Agents Registration Authority (MARA) registered agents who are bound by:

  • Migration Agents Code of Conduct
  • Professional and ethical standards
  • Continuing professional development requirements
  • Client confidentiality obligations

MARA Registration Numbers: All our registered migration agents display their MARA numbers on correspondence and our website. You can verify registration at mara.gov.au

Your Responsibilities

Information and Documentation

You agree to:

  • Provide complete, accurate, and truthful information
  • Supply all requested documents in a timely manner
  • Inform us immediately of any changes to your circumstances
  • Ensure all documents are authentic and properly translated
  • Respond promptly to requests for additional information

Payment Obligations

  • Pay all fees as agreed in your service agreement
  • Cover government application fees and third-party costs
  • Make payments according to the agreed schedule
  • Notify us of any payment difficulties in advance

Communication

  • Maintain regular contact throughout your matter
  • Check and respond to emails promptly
  • Attend scheduled appointments and consultations
  • Provide updated contact information when it changes

Important: Failure to meet these responsibilities may result in delays, additional costs, or the inability to proceed with your matter.

Fees and Payment Terms

Fee Structure

  • Professional Fees: As specified in your service agreement
  • Government Fees: Paid directly to immigration authorities
  • Third-party Costs: Skills assessments, medical examinations, translations
  • Additional Services: Any work outside the original scope

Payment Terms

  • Initial consultation fees are payable at the time of booking
  • Service fees may be payable in instalments as agreed
  • Government and third-party fees are payable when due
  • Outstanding invoices are payable within 14 days of issue
  • Late payment may incur interest charges and collection costs

Refund Policy

  • No refund: Government and third-party fees once paid
  • Partial refund: Unused professional fees if engagement is terminated
  • Full refund: If we cannot improve your prospects (terms apply)
  • Cooling-off period: 5 business days for new clients (conditions apply)

Service Limitations

No Guarantee of Outcomes

While we strive for successful outcomes, we cannot guarantee:

  • Visa approval or any specific immigration outcome
  • Processing timeframes by government authorities
  • Changes to immigration law or policy
  • Third-party decisions or actions

Legal Advice Limitation

Our services are limited to immigration matters. We do not provide:

  • General legal advice outside immigration law
  • Tax or financial planning advice
  • Property or business law guidance
  • Family law or relationship counselling

Limitation of Liability

Our total liability to you for any claim arising from our services is limited to the professional fees paid to us. We are not liable for:

  • Consequential or indirect losses
  • Lost opportunities or future earnings
  • Government or third-party actions
  • Delays beyond our reasonable control

Confidentiality

Our Obligations

We maintain strict confidentiality of all client information and will not disclose your information except:

  • With your written consent
  • To government authorities as required for your matter
  • To third-party service providers under confidentiality agreements
  • When required by law or court order
  • To protect our legitimate interests (e.g., debt recovery)

Mutual Obligations

Both parties agree to maintain confidentiality regarding:

  • Personal and financial information shared
  • Immigration strategies and advice provided
  • Sensitive family or business information
  • Any privileged communications

Termination of Services

Client Termination

You may terminate our services at any time by providing written notice. Upon termination:

  • You remain liable for fees incurred to the termination date
  • We will provide all documents and files relating to your matter
  • We may charge reasonable costs for file transfer
  • Confidentiality obligations continue indefinitely

Our Termination Rights

We may terminate our services if:

  • Fees remain unpaid after notice
  • You fail to provide required information or documents
  • There is a conflict of interest or professional conduct issue
  • You provide false or misleading information
  • The professional relationship breaks down irretrievably

Notice Period: We will provide reasonable notice of termination except in cases of serious misconduct or ethical breaches.

Intellectual Property

Website Content

All content on our website, including text, graphics, logos, and software, is owned by DazzleDeer or our licensors and is protected by copyright and other intellectual property laws.

Client Documents

  • You retain ownership of all personal documents provided to us
  • We retain intellectual property rights in advice and strategies we develop
  • You may use our work product solely for your immigration matter
  • Neither party may use the other's confidential information commercially

Dispute Resolution

Resolution Process

If you have a concern or complaint:

Step 1: Contact your migration agent directly to discuss the issue
Step 2: If unresolved, escalate to our Principal Consultant
Step 3: Consider mediation through an independent mediator
Step 4: Lodge a complaint with MARA or pursue legal remedies

Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

General Provisions

Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated to existing clients, and continued use of our services constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with your specific service agreement, constitute the entire agreement between us and supersede all prior negotiations, representations, or agreements.
